Terms of Service

• Community Guidelines. what may and may not be published or said anywhere on Guava, and what happens when the rules are broken.
• Privacy Policy. what personal data we handle and why.
• Cookie Policy. the cookies and device storage the platform relies on.
• Copyright and Content Complaints. how rights owners and other complainants ask us to remove something.
• Creator, Brand and Partner Terms. the extra rules for anyone who publishes, promotes or sells through Guava.

• You are 18 or older. the age of majority in Tanzania. Guava is not designed for children and we do not knowingly allow accounts held by anyone under 18.
• You can enter a contract. you have legal capacity under the Law of Contract Act and are not barred from agreeing to these Terms.
• You are not banned. we have not previously removed your account, and you are not creating an account to get around a suspension, restriction or ban.
• Your details are true. the name, username, email address and any other information you give us are accurate and kept up to date.
• The law permits it. using Guava is lawful where you are, and you are not a person or entity subject to sanctions or a legal order that prohibits it.

• Keep it secure. choose a strong password, do not reuse it elsewhere, and do not share it. Tell us immediately if you suspect someone else has access.
• One person, one account. an account belongs to the human being or organisation that opened it. Do not sell, rent, lend or transfer an account, a username or a verified badge.
• Usernames. your username is a handle we license to you, not property you own. We may reclaim, change or release a username that is inactive, impersonating, misleading, offensive, infringing, or reserved for someone else, and we may do so without notice.
• Verification. a verified badge and creator status are granted at our discretion, are not a guarantee of anything about the account holder, and can be withdrawn at any time.
• Accuracy. keep the email address on your account working. It is how we reach you about enforcement, security and changes to these Terms.

• We do not endorse user content. publishing something on Guava is not our agreement with it, our verification of it, or our recommendation of it. Opinions belong to the people who wrote them.
• We do not pre-approve everything. we review reports and we run automatic and manual checks, but we do not read everything before it is published and we do not promise to catch every breach of the rules.
• Nothing here is professional advice. documentaries, research summaries, articles, courses and comments are for general information. They are not medical, legal, financial, agricultural, veterinary, engineering or any other professional advice. Speak to a qualified professional before acting on anything you read.
• Courses are not accredited. our courses, quizzes and certificates record that you completed material on Guava. They are not a qualification, are not accredited by NACTVET, TCU or any other authority, and confer no academic or professional standing.
• We are not a broadcaster or a news agency. channel listings and video embeds point to streams and videos run by other people. We do not control them and we are not responsible for what they carry.

• Break any law of Tanzania or of the country you are in, or help anyone else to break one.
• Defraud, scam, deceive or financially exploit anyone, including through fake investments, money doubling, pyramid or network schemes, fake jobs, fake charities, phishing or counterfeit goods.
• Harass, bully, threaten, stalk or pile on to any person, or leave comments whose purpose is to humiliate or distress rather than to say anything. Criticism of someone's published work is not this.
• Incite hatred, discrimination or violence against people on the basis of tribe, ethnicity, race, colour, religion, nationality, sex, gender, disability, health status or any other protected characteristic. Criticising ideas, doctrines and institutions is allowed.
• Campaign politically, or publish breaking news coverage of an unfolding event. Political and breaking news content is allowed only where it is strictly educational, and only from an account with approved creator status. See the next section.
• Publish sexual content, nudity, or anything that sexualises a child. Content sexualising a child is removed immediately and permanently and closes the account.
• Publish violence, gore, threats, terrorism or content that glorifies or encourages harm, including self-harm and suicide.
• Publish information you know to be false where it is likely to cause serious harm, fabricated documents, or manipulated or generated media presented as a record of something real without a label.
• Publish other people's private information, private images or recordings without their consent.
• Infringe anyone's copyright, trademark, image rights or other rights.
• Spam, farm engagement, run bots, scrape the platform, buy or sell followers, likes or accounts, or evade a restriction with a second account.
• Impersonate any person, brand, publication, government body or Guava itself.
• Distribute malware, phishing links, or anything that damages, overloads, probes or interferes with Guava, its infrastructure or other people's use of it.
• Reverse engineer, decompile, copy or resell any part of the service, or access it by any automated means we have not authorised in writing.

What counts as strictly educational

• Explaining how something works: an electoral process, a piece of legislation, a court ruling, a budget, a government institution.
• Historical and archival material about a past political or news event, presented with sourcing and context rather than as a live account.
• Analysis of a policy, a law or a public decision, addressed to the substance rather than to a person, published after the fact rather than as the story breaks.
• An explainer that helps a reader understand a current event, provided it does not itself serve as the first report of that event.

Not allowed

• Live or breaking coverage of an unfolding event: reporting something as, or shortly after, it happens, before it can be properly sourced and placed in context.
• Campaigning for or against a party, candidate, coalition, referendum or political cause, and party slogans, symbols or colours used as promotion.
• Voter mobilisation and voter suppression, and telling people how to vote.
• Organising or calling for protests, demonstrations, strikes or civil disobedience.
• Political fundraising and political advertising, paid or unpaid.
• Rhetoric that dehumanises political opponents, or that stirs ethnic, regional or religious division for political ends.
• Fabricated political or news claims: invented quotes, invented results, doctored footage, or false claims about an election, an event or a public official.

• Why it has to be sublicensable. your files sit with our hosting and delivery providers. Without that permission they could not serve your work to a reader.
• How long it lasts. the licence ends when you delete the content and the deletion window in section 12 has run out, except for copies retained in backups and logs until they are overwritten, and copies we must keep for a legal or regulatory reason.
• What it does not cover. we will not sell your work, license it to a third party as a standalone product, or use it in paid advertising for Guava without asking you first.
• Promotion of your work. we may feature your published work inside Guava and in our own posts about Guava, using its title, an excerpt, its cover image and your public name or handle.

• We do not control them. we do not check, endorse or take responsibility for third-party sites, streams, products, prices, claims or privacy practices. Following a link takes you outside Guava and outside this agreement.
• Their terms apply. an embedded video or stream is governed by the terms and privacy policy of whoever runs it.
• Connected applications. you can authorise a third-party application to reach parts of your Guava account. You choose what to authorise, you can withdraw it at any time, and you are responsible for what an application you authorised does with that access. Authorisations are logged.
• Infrastructure. we build on third-party infrastructure for hosting, storage, databases, email and delivery. An outage or failure at one of those providers is outside our control.

• Deals are between you and the other person. if you buy from a partner listing, hire a creator, sponsor an article, sell a product, or agree anything else you found through Guava, that contract is between the two of you. We are not a party to it, we do not guarantee it, and we cannot refund it.
• Prices shown are theirs, not ours. prices, currencies, availability and claims on listings are set by the person who posted them and are their responsibility.
• Check before you pay. verify who you are dealing with before sending money. We will act on scam reports, but we cannot recover money you have already sent.
• Tax. each of us handles our own tax. If you earn money through work published on Guava, you are responsible for declaring and paying whatever the Tanzania Revenue Authority or your own tax authority requires. We do not withhold or remit tax for you.
• No earnings promise. we do not promise reach, views, followers, sponsorship, revenue or any commercial outcome from using Guava.

• We take the smallest step that works. for most first breaches that means asking you to correct something, or removing one item, rather than restricting the account.
• You are told what and why. when we remove content or restrict an account we say what was actioned and which rule it broke, unless telling you would endanger someone or compromise an active investigation, and then we tell you once that reason has passed.
• You can ask a person to look again. every enforcement decision can be reviewed by a person who is able to overturn it. Write to us within 30 days. The Community Guidelines set out the process; after one review, the decision stands.
• New accounts are limited. for a short period after signing up, new accounts have a daily posting limit and their posts may be checked before they are shown widely. This exists to stop spam and scam waves and is not a judgement about you.
• Suspension is quiet. when an account is suspended, its profile, posts, courses and chats stop being visible and readers are simply told the account is unavailable. We do not announce suspensions.
• Reports. anyone can report a post, a comment, an account or a listing, and reports are never shown to the person reported. Filing reports maliciously or in bulk is itself a breach of the rules.

• You can change your mind. within the window above, restore the item or cancel the account closure and everything comes back.
• Some things do not disappear. copies may remain in encrypted backups until they are overwritten, in server logs, in moderation and legal records we are required to keep, and in anything other people lawfully copied, quoted or shared before you deleted it.
• Messages you sent. deleting your account removes your side of a conversation. It does not delete the copy held by the person you were talking to.
• Closing is not an escape. closing an account does not end an investigation, cancel a restriction, or wipe our record that the account was restricted.

• No uptime guarantee. we give no service level commitment. Downtime, maintenance, data loss, delays, lost drafts and failed uploads can happen.
• Features may go. any feature, including courses, channels, chat, partner listings or creator tools, may be withdrawn.
• The service may end. we may stop operating Guava entirely. Where we reasonably can, we will give notice and a period in which to export your work, but we do not guarantee it.
• Test features. anything labelled beta, preview or experimental is provided as is and may break or disappear without notice.

• any indirect, incidental, special, consequential, exemplary or punitive loss;
• loss of profit, revenue, business, goodwill, opportunity, reputation, audience, followers or anticipated savings;
• loss, corruption or unavailability of content, drafts, messages, course progress or data;
• anything published, said, done or promised by another user, including fraud, defamation, harassment, infringement or a transaction that went wrong;
• the content, security or conduct of any third-party site, stream, embed, application or provider; or
• any interruption, delay, security incident or failure outside our reasonable control.

• anything you publish, send, upload, stream, sell or promote on Guava;
• your breach of these Terms, the Community Guidelines or any other document that forms part of this agreement;
• your breach of any law or of anyone else's rights, including intellectual property, privacy, image and reputation rights; and
• any dispute between you and another user or any third party.

• By you. stop using Guava and close your account from Settings at any time.
• By us. we may suspend or end your access, with or without notice, if you breach this agreement, if we reasonably suspect unlawful or harmful activity, if a law or authority requires it, or if we stop offering the service.
• What survives. the sections on your content licence, disclaimers, limitation of liability, indemnity, governing law and general terms continue to apply after this agreement ends.
• No compensation. we owe you nothing for lost access, lost content, lost audience or lost income when an account ends, however it ends.

Talk to us first

2. 2Give us 30 days from the date we receive it to respond and to try to resolve it with you in good faith.
3. 3If it is still unresolved after that period, either of us may take the matter further.

• Whole agreement. these Terms and the documents listed in section 1 are the entire agreement between us about Guava, and replace anything said before.
• Severability. if a court finds any part unenforceable, that part is narrowed to the minimum extent needed, or removed, and everything else stays in force.
• No waiver. if we do not enforce something immediately, we have not given up the right to enforce it later.
• Assignment. you may not transfer your rights under these Terms. We may transfer ours to a successor or purchaser of the business.
• No third-party rights. no one other than you and Guava can enforce these Terms.
• Notices. we contact you through the app or at the email address on your account, and that counts as delivered. You contact us at this address.
• Events outside our control. we are not liable for failure or delay caused by anything beyond our reasonable control, including power and network failure, provider outages, cyber attack, natural disaster, epidemic, civil disruption, or an act of government or a regulator.
• Relationship. these Terms create no partnership, employment, agency or joint venture between us.
